SafeHerit Terms of Service

Welcome to SafeHerit (“we,” “us,” “our,” or “SafeHerit”).
These Terms of Service (“Terms”) govern your access to and use of the SafeHerit platform, website, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, do not use SafeHerit.

 

1. ABOUT SAFEHERIT

SafeHerit is a digital platform designed to help users securely record information about their assets and define who should receive that information in the event of their death or permanent unavailability.

SafeHerit does not store or manage your actual assets (such as money, property, or investments). It only stores encrypted information that you input and assign to your designated individuals (“Beneficiaries”), as well as contact details for optional trusted persons (“Validators”) whose role is limited to confirming your status.

SafeHerit is not a legal will, not a financial service, and not a substitute for professional legal advice. We strongly recommend that you consult a qualified legal advisor to prepare a valid will or trust in accordance with your jurisdiction.

For the purpose of this Agreement:

  • Verified Passing refers to the status determined by the SafeHerit system when a user’s passing has been confirmed through the combination of configured Pulse Check procedures and, if applicable, Validator confirmations. Verified Passing does not constitute a legal verification of death.
  • Permanent Unavailability refers to a state where the user is unreachable or inactive for an extended period as defined by their chosen Pulse Check settings, and optionally, when Validators (if designated) have confirmed that the user cannot be contacted. Permanent Unavailability does not necessarily indicate legal death, and users acknowledge that SafeHerit’s release of data in such cases is automated based on their predefined configuration.

 

2. ELIGIBILITY

To use SafeHerit, you must:

  • Be at least 18 years of age or the age of legal majority in your jurisdiction;
  • Have the legal capacity to enter into a binding contract; and
  • Use the Service in compliance with all applicable laws and regulations.


By creating an account, you represent and warrant that you meet these requirements.

 

3. ACCOUNT REGISTRATION AND SECURITY

You must register an account to use the Service. During registration, you will be asked to provide certain personal information and to create a password.

You are responsible for maintaining the confidentiality of your login credentials. You agree to immediately notify us of any unauthorized access to your account. You are solely responsible for all activities conducted under your account.

Private Key: Upon registration, SafeHerit generates a unique cryptographic key pair (Public and Private Keys) directly on your device and outside of SafeHerit servers. Your Private Key never leaves your device and is never known to SafeHerit.

If you lose your Private Key, we cannot recover your encrypted data. You are responsible for securely storing your Private Key and, if applicable, for securely transmitting private keys to your Beneficiaries.

 

4. SERVICE OVERVIEW

SafeHerit allows you to:

  • Record and encrypt descriptions of your assets and related instructions;
  • Designate Beneficiaries to receive specific encrypted data after your verified passing or permanent unavailability;
  • Appoint Validators who can confirm your status if you become unresponsive; and
  • Configure “Pulse Checks” to confirm your continued activity or request confirmation through your Validators.


All sensitive information is encrypted on your device before being sent to our servers. SafeHerit never has access to or control over your unencrypted data.
Beneficiary disclosures occur only upon Verified Passing or Permanent Unavailability as defined above. These triggers are determined solely by the user’s configured settings and, if applicable, Validator confirmations, and do not represent legal certification of death.

 

5. SUBSCRIPTIONS, PAYMENTS, AND REFUNDS

Subscription Terms

SafeHerit offers subscription-based plans. All payments are processed securely via our third-party payment processor (e.g., Stripe).

  • Auto-Renewal: Your subscription begins with a free trial period (if applicable) and will automatically renew at the end of the trial or billing period unless canceled before the renewal date.
  • Cancellation: You may cancel your subscription at any time through your account settings. Cancellation prevents the next billing cycle charge but does not retroactively refund past payments.
  • Refunds: We do not offer prorated refunds for unused time after a successful renewal.
  • Currency: All fees are denominated in USD (or as otherwise displayed) and include any applicable taxes unless stated otherwise.


Failed Payments and Account Restriction


If your subscription renewal payment fails (e.g., due to expired payment details or insufficient funds), SafeHerit will automatically transition your account into a restricted “Read-Only” mode.

  • Notification Period: SafeHerit will make reasonable attempts to notify you via your registered communication channels over a designated grace period (typically 30 days) to help you restore payment.
  • Data Preservation: During this period, your encrypted data remains securely stored, but you will not be able to edit or add new information until payment is resolved.

 

If you remain unresponsive or fail to renew your subscription by the end of the notification period (e.g., 30 days):

  • Account Freeze: Your account access will be temporarily suspended.
  • Safety Protocol: To ensure that a lapsed payment does not result in the loss of your legacy in the event of your actual incapacity, the system may automatically trigger your configured Pulse Check escalation.
  • Verification Window: During this phase, SafeHerit will attempt to contact you and, if applicable, your designated Validators or Beneficiaries to confirm your status. This process follows your pre-configured settings but operates on a timeline determined by our internal safety protocols.

 

If you confirm you are alive but payment is still pending, your account and Pulse Check remain paused for up to 90 days to allow renewal. After that grace period, your account and encrypted data will be permanently deleted.

If you complete payment at any time during these grace periods, your account will be fully restored, and your Pulse Check schedule reset.

 

6. DATA PRIVACY AND SECURITY

We take data privacy and security seriously.

  • All Sensitive Data (including information about your assets, testament messages, and uploaded files) is encrypted client-side using your public key and cannot be decrypted by us.
  • However, optional short messages you choose to have SafeHerit send by email (for example, notifications to beneficiaries or validators during the Pulse Check process) are transmitted through secure mail channels but are not encrypted with your private key.

7. BENEFICIARIES AND VALIDATORS

You are solely responsible for:

  • Registering accurate contact information for your Beneficiaries and Validators;
  • Communicating with them about their roles; and
  • Providing them with their private keys if applicable.


Beneficiaries and Validators have no legal or financial claim on your assets by virtue of being registered in SafeHerit. Their access is limited to the data you assign to them and does not constitute a legal entitlement.

8. USER RESPONSIBILITIES

By using SafeHerit, you agree that you will not:

  • Use the Service for illegal, fraudulent, or abusive purposes;
  • Store or share unlawful, defamatory, or harmful content;
  • Attempt to reverse-engineer or interfere with the Service’s security mechanisms;
  • Violate the privacy or rights of any third party; or
  • Attempt to gain unauthorized access to another user’s data.


You retain full responsibility for the accuracy, legality, and content of the information you upload to SafeHerit.

 

9. LEGAL DISCLAIMER
  • SafeHerit does not create a legally binding will, trust, or testamentary document.
  • SafeHerit is not a law firm and does not provide legal, tax, or financial advice.
  • The data stored on the platform is for informational purposes only and may not satisfy the legal requirements of a valid will in your jurisdiction.
  • Users are strongly encouraged to consult licensed professionals for estate planning and legal documentation.
  • SafeHerit’s verification processes are automated and depend on user-defined settings and, where applicable, third-party confirmations. They are not equivalent to legal determinations of death or incapacity. Users accept full responsibility for any release of data based on their own configuration.

 

10. SERVICE AVAILABILITY AND MODIFICATIONS

We strive to ensure continuous access to SafeHerit but do not guarantee uninterrupted operation.
We may update, modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.

In the event SafeHerit ceases operations, we will make reasonable efforts to provide advance notice and allow you to export or retrieve your encrypted data before deletion, to the extent technically and legally possible. However, SafeHerit cannot guarantee such notice in cases of sudden business discontinuation, legal injunction, or events beyond its control (such as insolvency, data corruption, or natural disaster).

 

11. ACCOUNT TERMINATION

You may delete your account at any time through your account settings.
Upon deletion, all data (including backups) associated with your account will be permanently deleted from our systems.

We may suspend or terminate your account if:

  • You breach these Terms;
  • We are required to do so by law; or
  • Continued service to you poses a security or operational risk.

 

12. INTELLECTUAL PROPERTY

All content and software comprising SafeHerit are owned by ESAN DIGITAL SOLUTIONS – FZCO, unless otherwise stated. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal purposes only. You may not copy, modify, distribute, or create derivative works of any part of the Service without our written consent.

 

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • SafeHerit and its affiliates, officers, directors, employees, or partners shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or relating to the use or inability to use the Service.
  • Because we cannot decrypt your data, SafeHerit bears no liability for any loss resulting from the loss or mismanagement of your Private Key, forgotten credentials, or miscommunication with your Beneficiaries.
  • In no event shall SafeHerit’s total liability exceed the total subscription fees paid by you during the twelve (12) months preceding the claim.

14. INDEMNIFICATION

You agree to indemnify and hold harmless SafeHerit and its affiliates, directors, officers, and employees from any claims, damages, liabilities, and expenses arising from:

  • Your misuse of the Service;
  • Your violation of these Terms; or
  • Your infringement of any third-party rights.

 

15. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates.
Any disputes shall be submitted to the exclusive jurisdiction of the courts of Dubai (UAE).

 

16. CHANGES TO THESE TERMS

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. If the changes are material, we will notify you through email or in-app notice and may request renewed consent.

Continued use of the Service after such updates constitutes your acceptance of the new Terms.
