Welcome to SafeHerit (“we,” “us,” “our,” or “SafeHerit”).
These Terms of Service (“Terms”) govern your access to and use of the SafeHerit platform, website, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, do not use SafeHerit.
SafeHerit is a digital platform designed to help users securely record information about their assets and define who should receive that information in the event of their death or permanent unavailability.
SafeHerit does not store or manage your actual assets (such as money, property, or investments). It only stores encrypted information that you input and assign to your designated individuals (“Beneficiaries”), as well as contact details for optional trusted persons (“Validators”) whose role is limited to confirming your status.
SafeHerit is not a legal will, not a financial service, and not a substitute for professional legal advice. We strongly recommend that you consult a qualified legal advisor to prepare a valid will or trust in accordance with your jurisdiction.

By creating an account, you represent and warrant that you meet these requirements.
You must register an account to use the Service. During registration, you will be asked to provide certain personal information and to create a password.
You are responsible for maintaining the confidentiality of your login credentials. You agree to immediately notify us of any unauthorized access to your account. You are solely responsible for all activities conducted under your account.
Private Key: Upon registration, SafeHerit generates a unique cryptographic key pair (Public and Private Keys) directly on your device and outside of SafeHerit servers. Your Private Key never leaves your device and is never known to SafeHerit.
If you lose your Private Key, we cannot recover your encrypted data. You are responsible for securely storing your Private Key and, if applicable, for securely transmitting private keys to your Beneficiaries.
SafeHerit allows you to:
All sensitive information is encrypted on your device before being sent to our servers. SafeHerit never has access to or control over your unencrypted data.
Beneficiary disclosures occur only upon Verified Passing or Permanent Unavailability as defined above. These triggers are determined solely by the user’s configured settings and, if applicable, Validator confirmations, and do not represent legal certification of death.
Subscription Terms
SafeHerit offers subscription-based plans. All payments are processed securely via our third-party payment processor (e.g., Stripe).
Failed Payments and Account Restriction
If your subscription renewal payment fails (e.g., due to expired payment details or insufficient funds), SafeHerit will automatically transition your account into a restricted “Read-Only” mode.
If you remain unresponsive or fail to renew your subscription by the end of the notification period (e.g., 30 days):
If you confirm you are alive but payment is still pending, your account and Pulse Check remain paused for up to 90 days to allow renewal. After that grace period, your account and encrypted data will be permanently deleted.
If you complete payment at any time during these grace periods, your account will be fully restored, and your Pulse Check schedule reset.

You are solely responsible for:
Beneficiaries and Validators have no legal or financial claim on your assets by virtue of being registered in SafeHerit. Their access is limited to the data you assign to them and does not constitute a legal entitlement.
By using SafeHerit, you agree that you will not:
You retain full responsibility for the accuracy, legality, and content of the information you upload to SafeHerit.
We strive to ensure continuous access to SafeHerit but do not guarantee uninterrupted operation.
We may update, modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.
In the event SafeHerit ceases operations, we will make reasonable efforts to provide advance notice and allow you to export or retrieve your encrypted data before deletion, to the extent technically and legally possible. However, SafeHerit cannot guarantee such notice in cases of sudden business discontinuation, legal injunction, or events beyond its control (such as insolvency, data corruption, or natural disaster).
You may delete your account at any time through your account settings.
Upon deletion, all data (including backups) associated with your account will be permanently deleted from our systems.
We may suspend or terminate your account if:
All content and software comprising SafeHerit are owned by ESAN DIGITAL SOLUTIONS – FZCO, unless otherwise stated. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal purposes only. You may not copy, modify, distribute, or create derivative works of any part of the Service without our written consent.
To the maximum extent permitted by law:
You agree to indemnify and hold harmless SafeHerit and its affiliates, directors, officers, and employees from any claims, damages, liabilities, and expenses arising from:
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates.
Any disputes shall be submitted to the exclusive jurisdiction of the courts of Dubai (UAE).
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. If the changes are material, we will notify you through email or in-app notice and may request renewed consent.
Continued use of the Service after such updates constitutes your acceptance of the new Terms.
